Looks like pop singer Des’ree is winning the war in this whole stolen song fiasco. Some of you might remember that “Who Sang It Better” post we made a few weeks ago featuring Des’ree and Beyonce singing the same song, ‘I’m Kissing You’. Word is Des’ree did not give Be and her crew permission to use her song on the deluxe album – but Beyonce said fuck it and used it anyway. And to add insult to injury, she even made a video for the song.
Well yesterday Columbia Records temporarily stopped distribution of the album, while they wait for a preliminary injunction hearing set for May 4th. $150,000 (the amount Des’ree is suing for) is chump change, she should have went for the millions!

Here’s why: There are people employed by the Record Companies (in this case Music World/Columbia/Sony Music Group) whose job is to be CERTAIN that all copyrights have been acquired and in the case that songs appear on the album, that have been written by someone else, then the rights to rerecord those songs have been purchased.

As for Bey, I kinda feel sorry for her, because I think she is not very bright and is manipulated by her father/handlers. Don’t get me wrong, she has some intelligence as far as her art goes, but I think her family should have stressed to her the importance of some formal education to complete her package.
That said, although I’m not big fan of hers, I can appreciate what she brings to the table, and let’s face it, the girl can break off a l’il sumpin’, sumpin’. As I’ve said before on these boards, she MUST be relevant because no other performer, at least as far I know, has been dissected and discussed, pro and con, as much as Beyonce has been. That, alone, should gain her at least SOME respect.
As for taking credit for other people’s shyt, and stealing songs, maybe she should take some of the heat, she ain’t no baby, but ultimately, she’s being poorly advised and needs to break away from her father, a la Janet & Michael. I can’t really say why she “re-released” the album, but I know she did record 7 songs in LATIN to appeal to her Latino fans.
Whether they were on this “re-released” version I’m not sure.

49, what are you talking about? Did you read any of the terms of the lawsuit? Des’ree and The Royalty Network are asking for 150k in damages and for Sony to cease the distribution of the cds and dvds with this song on it. This is what they WANT. This is not to say this is what they’ll GET. Sony could very well pony up BIG bucks to change the terms of the lawsuit so they can continue distribution. TRN might accept this settlment or they might not. If the judge agrees with TRN and Des’ree, Sony WILL have to halt the deluxe edition whether they like it or not. So, I was just commenting on those who think the lawsuit is dumb because they didn’t go for the big $$$ in the first place. They could end up with everything they’re asking for in the lawsuit or get more.
