Beyonce remade a song called “Still In Love (Kissing You)”, but it’s being reported she never had permission to record the song and is being hit with a lawsuit:
According to a lawsuit filed yesterday in Manhattan Federal Court by music administators, Beyonce allegedly never obtained proper clearance to cover a song called “I’m Kissing You,” originally co-written by a singer named Des’ree — famous for her 1994 smash hit, “Gotta Be.” Des’ree’s version was used in Baz Luhrmann’s 1996 film “Romeo and Juliet,” Beyonce’s version can be found on the re-release of her album, “B’Day.”
In the lawsuit, Des’ree and her reps claim that Beyonce, along with her record company people, originally tried to work out a deal to use the song. When they weren’t satisfied with the proposed terms — which included not being able to change the title or make a music video for the song — Beyonce’ allegedly blew off copyright law completely, and recorded the song and video without permission. The song was eventually released on Beyonce’s album, “B’Day - Deluxe Edition” on April 3, 2007, with the title “Still in Love (Kissing You).”
Des’ree is suing to halt distribution of the song, video and album and seeking at least $150,000 in damages. READ MORE
Looks like Bee went hard on them and said she gonna do this song for her man. I’ve always like Des’ree though, she has a beautiful voice and I found it odd for Beyonce to remake the song anyway seeing how it was released and plenty people know about it. Des’ree created that song and sings it like it means something to her, there’s a special quality in her voice. That’s why Beyonce wanted to challenge herself to remake it. But Beyonce just doesn’t have the maturity and wisdom in her voice to sing that song as well as Des’ree. Also there is no excuse for using something of someone else’s without permission. All you stans taking up for Beyonce probably steal money from your momma’s purse and think there’s nothing wrong with it.

#6 - you ask who Des’Ree is??? SMH. She’s put out great music with content that is awesome and lyrics that are poetic and beautiful. In my opinion, she sung it better as it IS her song…ALSO, the song was featured on the film adaptation of “Romeo and Juliet” starring Claire Daines and Leonardo DiCaprio. I bought the romeo and juliet soundtrack just for desiree’s version, I had no clue who she was and saw the movie and heard the song and I had to have it, the emotion is so raw and pure. I still play the cassette (yep cassette) to this day-
I heard beyonce’s version as well, I think that they both bring their own individual sound and emotion to it-to me you either like one or the other depending on your personal preference-I loooove beyonce without a doubt and like her version, but I prefer desiree’s version-two totally different singers and two different styles-does one necessarily have to be better why can’t we appreciate both versions?

I have the entire Des’Ree version and have listened to it a million. It’s one of my favorite songs in the world and she kills it. The type of emotion and soul she sings with could never be matched, definitely not by Bey. Don’t get me wrong: Bey can sing and she has a nice voice but with the exception of Dangerously In Love [the song], I’ve never really heard that type of passion emanate from her. Bey’s version is boring with some simplistic, overdone lyrics that make it so wack. As I said when she first released it, Des’Ree’s version is so beautiful and passionate and incredible from start to finish and it should have been left alone.

It works like this: someone finds a recording and can’t find the copyright owner so they pay a filing fee to the copyright office and are free to use or incorporate it into another work without it being an infringement, only paying royalities if the original composer comes forward with an infringement lawsuit, then only paying royalties from the time the copyright claim is made, legal fees exceeding royalties.
Record labels do it all the time. How do you think people sample so much music in rap? You get a compulsory liscense and make the track. Kanye West, everybody does it.
I like both versions. One has what the other one doesn’t.

I’m shocked that her record company would let something like this slide, there are entire departments dedicated to making sure the songs they put out are legally sound.
I can’t decide if “only” suing for $150,000 proves the case or not….One might say suing for such a small amount shows that they have nothing in favor, but then again one could say the small amount shows they aren’t suing just to get rich, they have an actual case.
Part of me thinks that Beyonce messed this up because she went into hiding recording this album and had no one check up on her (haha) since she said she had everything under control.

Okay, well I’m in the industry and I have to say this was the stupidiest move on Beyonce’s part. Very stupid. First off, for those who think that Beyonce went ahead and recorded the song without permission already knowing how much she would have gotten sued for, it doesn’t work that way. Beyonce had no idea how much she would have gotten sued for. That figure came along after the fact. So let’s say Des’ree asked for more money…way more than what she is seeking. Would it really have been worth it? Aside from that, this makes Beyonce a figure that some may not want to work with in the future. Imagine if other artists just went ahead and recording material they didn’t receive permission or clearance on with the thought in the back of their mind that they could afford the lawsuit. It’s the dumbest thing an artist can do, because in the end it will hurt their reputation and ultimately their career.

The love theme from “Romeo & Juliet” finds favour with the US superstar - but legal problems abound…
The beautiful world superstar Beyonce is rapidly becoming one of the favourite Westbury artistes.
A couple of months ago, she put out a version of her “Ring The Alarm” single with samples from the Winston Riley/Tenor Saw track “Ring The Alarm”. This pleased us.
Now we are delighted. Because she has covered the tune “Im Kissing You”, written by Desree and Westbury writer Tim Atack.
The tune first came to attention as the Love Theme from the Baz Luhrmann 1996 version of “Romeo And Juliet” and, since then, has featured on more than 50 compilations and has become one of the best-known Desree tunes, even though it has never been released as a single.
But this new version has caused problems to do with the unlicensed adaptation (new lyrics inserted) and the fact her record company has sought to re-title her version. These might still bring the use to court. We would hope not but we have the rights of the writer to protect!
The new version has already been done on video, showing it may be being thought of as a future single.
