I was upset when I heard she was released on house arrest. When I heard some of the facts surrounding the charges I strongly believe the sentence was harsh.

I AM A DUI attorney and I will admit that typically what happens when the person first gets the DUI is you try to get the charge reduced. Why, because you know there is always the temptation to want to drive. This is especially true in states where drive is an absolute necessicity. From what I have heard, when she was stopped for the DUI, her blood alcohol level was .08. The limit is .08 but you can be at .08 for having a glass of wine. In situations like that what the prosecutors normally do is reduce the charges to reckless driving especially if it is the offenders first DUI.

Okay, that didn’t happen here and she got the DUI. With the DUI you gets fines, classes, probation, etc. and a suspended license for one year. BUT at times you can be eligible for a license before the end of the year if you complete all of the classes and pay the fines, etc. From what I heard, she was eligible to get a license, she didn’t get the paper work done.

Granted, driving with a suspended license is a crime, especially when the suspension is due to a DUI. BUT, normally a person in this position (AS A FIRST TIME OFFENDER) would either have to beg beg beg and get probation reinstated and get community service, etc. OR worse case scenario maybe 10 days in jail. Not 45 days that is for sure. I know if a prosecutor were to offer me 45 days in jail, I would have immediately known this was not serious and just a strategy to negotiate for a lower sentence by starting high.

I am tore about how to feel for her knowing her sentence was harsh even for Tyrone on a street corner it would have been harsh and wouldn’t have happened. I think the better idea would have been to do maybe a weekend jail or something like that.

Good to hear from someone who knows the law, I’m wondering if they gave her this sentence because of all the accidents she been in and has laughed them off. I saw a tape of her in a parking deck backing out of her parking space, hit another car laughed it off and kept rolling…..she was wrong for that, just cause you have money and are a celebrity you can’t just do whatever you want, I hope this teaches her a lesson….spoiled little rich girl, poor thing probably can’t stand it in that cell…..long ways away from Beverly hills.
