JENA 6 UPDATE: BELL OUT ON BAIL / DR. PHIL TO DO A SHOW

Good news on the Jena 6 case. 17 year-old Mychal Bell has been released on bail. His bail was set at $45,000. The LaSalle Parish District Attorney said his decision not to appeal was not influenced by the recent march.

“We still have mountains to climb, but at least this is closer to an even playing field,” said the Rev. Al Sharpton, who helped organize last week’s protest.

“He goes home because a lot of people left their home and stood up for him,” Sharpton said.

District Attorney Reed Walters’ decision to abandon adult charges means that Bell, who had faced a maximum of 15 years in prison on his aggravated second-degree battery conviction last month, instead could be held only until he turns 21 if he is found guilty in juvenile court.

He is still facing charges in juvenile court as is another of the six for a total of TWO. the OTHER FOUR are still facing charges that carry potential PRISON TIME. One is STILL charged with ATTEMPTED MURDER. Those who have been involved have placed POSITIVE PRESSURE, but it is not over. Remember that the devil is always busy and this time next month they will have continued with a degree of injustice. I don’t want to damper a parade, I am just saying we have to stay on top of this one.

Lessons from Jena, La.

Now we love Mychal Bell, the star of the 2006 Jena (La.) High School football team, the teenage boy who has sat in jail since December for his role in a six-on-one beatdown of a fellow student.

Thursday, thousands of us, proud African-Americans, expressed our devotion to and desire to see justice for the “Jena Six,” the half-dozen black students who knocked unconscious, kicked and stomped a white classmate.

Jesse Jackson compared Thursday’s rallies in Jena to the protests and marches that used to take place in cities like Selma, Ala., in the 1960s. Al Sharpton claimed Thursday’s peaceful demonstrations were to highlight racial inequities in the criminal justice system.

Jesse and Al, as they’re prone to do, served a kernel of truth stacked on a mountain of lies.

There are undeniable racial and economic inequities in our criminal justice system, and from afar the “Jena Six” rallies certainly looked and felt like the righteous protests of the 1960s.

But the reality is Thursday’s protests are just another sign that we remain deeply locked in denial about the path we need to travel today for true American liberation, equality and power in the new millennium.

The fact that we waited to love Mychal Bell until after he’d thrown away a Division I football scholarship and nine months of his life is just as heinous as the grossly excessive attempted-murder charges that originally landed him in jail.

Reed Walters, the Jena district attorney, is being accused of racism because he didn’t show Bell compassion when the teenager was brought before the court for the third time on assault charges in a two-year span.

Where was our compassion long before Bell got into this kind of trouble?

That’s the question that needed to be asked in Jena and across the country on Thursday. But it wasn’t asked because everyone has been lied to about what really transpired in the small southern town.

There was no “schoolyard fight” as a result of nooses being hung on a whites-only tree.

Justin Barker, the white victim, was cold-cocked from behind, knocked unconscious and stomped by six black athletes. Barker, luckily, sustained no life-threatening injuries and was released from the hospital three hours after the attack.

A black U.S. attorney, Don Washington, investigated the “Jena Six” case and concluded that the attack on Barker had absolutely nothing to do with the noose-hanging incident three months before. The nooses and two off-campus incidents were tied to Barker’s assault by people wanting to gain sympathy for the “Jena Six” in reaction to Walters’ extreme charges of attempted murder.

Much has been written about Bell’s trial, the six-person all-white jury that convicted him of aggravated battery and conspiracy to commit aggravated battery and the clueless public defender who called no witnesses and offered no defense. It is rarely mentioned that no black people responded to the jury summonses and that Bell’s public defender was black.

It’s almost never mentioned that Bell’s absentee father returned from Dallas and re-entered his son’s life only after Bell faced attempted-murder charges. At a bond hearing in August, Bell’s father and a parade of local ministers promised a judge that they would supervise Bell if he was released from prison.

Where were the promises and supervision before any of this?

It’s rarely mentioned that Bell was already on probation for assault when he was accused of participating in Barker’s attack. And it’s never mentioned that white people in the “racist” town of Jena provided Bell support and protected his football career long before Jesse, Al, Bell’s father and all the others took a sincere interest in Mychal Bell.

You won’t hear about any of that because it doesn’t fit the picture we want to paint of Jena, this case, America and ourselves.

We don’t practice preventive medicine. Mychal Bell needed us long before he was cuffed and jailed. Here is another undeniable, statistical fact: The best way for a black (or white) father to ensure that his son doesn’t fall victim to a racist prosecutor is by participating in his son’s life on a daily basis.

That fact needed to be shared Thursday in Jena. The constant preaching of that message would short-circuit more potential “Jena Six” cases than attributing random acts of six-on-one violence to three-month-old nooses.

And I am in no way excusing the nooses. The responsible kids should’ve been expelled. A few years after I’d graduated, a similar incident happened at my high school involving our best football player, a future NFL tight end. He was expelled.

The Jena school board foolishly overruled its principal and suspended the kids for three days.

But the kids responsible for Barker’s beating deserve to be punished. The prosecutor needed to be challenged on his excessive charges. And we as black folks need to question ourselves about why too many of us can only get energized to help our young people once they’re in harm’s way.

I’ve been the spokesman for Big Brothers Big Sisters of Greater Kansas City for six years. Getting black men to volunteer to mentor for just two hours a week to the more than 100 black boys on a waiting list is a yearly crisis. It’s a nationwide crisis for the organization. In Kansas City, we’re lucky if we get 20 black Big Brothers a year.

You don’t want to see any more “Jena Six” cases? Love Mychal Bell before he violently breaks the law.

I support the ’cause’ behind the situation in Jena because the sentencing was unfair but fighting anyone that is racist will not make them change their views. We have to be smarter than that. There are many ‘missing’ facts from this story that many of us were never told (which is why I posted the article above). Racism is alive and well people but we also must know ALL the facts ALL the time. I was glad that Al Sharpton acknowledged tonight that we should not be condoning that fight…it was WRONG but justice should be fair regardless of the circumstances.

And what path is that Jason? Follow the status quo. Color INSIDE the lines. Refrain from rocking the boat? In the past I’ve agreed with some of the things this brother has to say but he missed the mark here. I saw this entire article as a slap on the hand to Black folks instead of it addressing the underlying root of the real problems in America. Yes, Black boys need their father. Yes, Blacks tend to rally when their own is looking down the same barrel they might have just pointed at someone else (Not my baby. My baby would never hurt a fly!) Ms. Mac, I respect your opinion. The nooses were wrong, the school should have handled the situation differently, we’ve all agreed on that but we allow our emotion to get in the way of our judgement all to often. This isn’t the first time nooses have been hung on a highschool campus of a predominately white school and nothing was done. I understand everything…..racism is alive and well but we are quick to defend our own even when sometimes we know that they may not always be right. We as a people will NEVER advance if we always think this way. It’s deeper than that….use your head sista. The march gave this boy freedom which after 9 months…he definitely deserved. But are we going to run and protest for every black male that beats up a person that has made a racist gesture? As hurtful as these gestures are…they give no one the right (especially 6 athletes) to beat the hell outta one person. Oprah is out of the country right now supporting her school in Africa but she probably won’t speak on this because the fight does not sit well with her. Oprah was very close to Coretta Scott King and definitely understands and respects the morale of making a statement without the use of violence. This entire situation has been tragic.

This is tragic in all it’s forms, the young white fellow who got beat down, it is also tragic for him, I am happy that Mr. Bell is free on bond, I would suggest a different path for him from now on, one less violent, I grew up in the sixties in the Watts section of Los Angeles, when LA got burned up, no matter the situation I am happy to see in my lifetime that Black People came together for a cause that had nothing to do with the negatives so long attached to our people, so remember this we can effect change, even if it was fueled by filtered information, we can make this country change, stay close people, the revolution will be televised, on all channels.

Listen sis. You are preaching to the choir when it comes to discussing individual responsibility. I have been on this website for a minute and my history shows that I NEVER cry about what the “Man” is supposed to do for us. I am all about taking responsibility for our {own} actions, accepting your faults, picking yourself up, being about something. So right there we can agree. What I have a problem with is that people are letting Bell’s personal issues (whatever they are) skew the larger picture at hand. Do you think it’s a coincidence that the fighting incident gave rise to this issue of disparity in the Jena penal system? Do you think it was any coincidence that the national media initially gave this no attention whatsoever but now are desperate to paint a picture of the perpetrators as victims??? This is bigger than Bell and all I am saying is that Blacks have a right and a duty to bring the REAL issue to the forefront. We’ve pretty much all got dirt in our backyards. But to suggest that we shouldn’t come together simply because Mychal has past transgressions is an insult to our intelligence.

Look at it like this. Just because someone does something wrong it doesn’t mean they can’t be wronged. And just because they deserve to be punished for their wrongdoings it doesn’t mean we should overlook or downplay and wrong done to them. It’s not about coming out 50-50. It’s about highlighting issues that Black and White America have ignored and side-stepped for too long. Bell was merely a catalyst for the boil called racism that’s festering on the ass of America. People marching on Jena was necessary. It’s too bad that little boy got his ass whooped. However, he just took one for the team. And personally, I could give a sh!t about him getting beat up. Innocent people get their asses kicked everyday. Just like innocent men and women get put away or like when different people get different sentences for the same exact crime. I’m sorry if you don’t get that. And if you don’t, let’s agree to disagree and press.

To Ms Nawlins and those who think like yourself, actually this young white boy is not just an innocent victim here, if he is doing something like hanging nooses is actually a non vocal form of a terroristic death threat meant to incite fear and intimidation. It is a vicious act essentially saying that we are going to hang some “n” words. Secondly, there is fact that these whites kids have been racially harassing bell and his friends for some months before the actual fight took place. I am sure that means racially charged words like the “n” word, or coon, or what have you. And according to the United States constitutional law, those words constitute as Fighting Words. That’s right, words that are expressed to incite hatred or violence. In this case, he got the latter. Also, we must forget the most the most obvious, which is the white boys conspiracy to incite a riot. Lest we forget the meaning of a riotous act, which includes hanging nooses, or calling a group of people the “n” word. A riot according to United States law is commonly defined as an act or acts of violence by one or more persons part of an assemblage of three or more persons, which act or acts shall constitute a clear and present danger of, or shall result in, damage or injury to the property of any other person or to the person of any other individual.

See how important it is to read and understand the laws thoroughly? I dont know michael bell’s or the jena 6 lawyers, but they are in desperate need of legal counsel who pays attention to details. I am very surprised no one has bought this up! Everyone knows that a judge, DA, or whoever knows the law well, but a good lawyer knows it better. Because this prosecutor was dead wrong for saying he could find nothing under Louisiana law to convict Barker(white boy) with, when I just did three state and federal charges. I do not run around condoning fights, however, it takes two to tango.

I don’t think the issue was never about whether or not Bell should be punished. The issue was about whether his punishment was fair. Now, if Bell was expelled from the school, there wouldn’t have been any marched or media coverage. That’s the dichotomy of LAWS in America…it’s left to the interpretation of prosecutors. Somehow, this prosecutor felt the need to push the hardest punishment possible. Why? Do you mean to tell me, Bell was the first black boy to have a fist brawl in a public school in America? This punishment was unprecedented. There is an underlying tone of racism in the prosecutors and judges handling of this trial. This must be dealt with.

While I agree that blacks in America have renege on their responsibilities as parents, leaders to their kids and communities… I can’t put all of the blame on black men or black people. There is a reason why Across America, Blacks are more likely than any other groups to be disenfranchised, drop out of school, run-in with the law, divorce, have kids out of wedlock, suffer STDs, have highest rate of infant mortality, die earlier from high blood pressure and stress. These aren’t jut coincidences and they didn’t happen over night.

These are the effects of the ravages of drugs in the black community, which created a bunch of mindless zombies. These are the effects of welfare, which created an economically handicapped welfare class, who would have babies out of wedlock to garner more government aid. These are the effects of the ghetto, a socially misfit class of people, who are ill-prepared to manage the trials and tribulation of today’s social world and economy.

Now, we can delve deeper and try to ascertain the real culprit of these atrocities…or, we can try to come with a solution. Part of the solution is that we must be held accountable for every choice we make…but, let’s not be naïve. There are forces in this world that will stop at nothing to see that black people remain a socially and economically inferior class. Until we realize this as a group, we will continue to chase after our own tails in circles and never arrive at a real solution. WE MUST TRY TO BECOME AN INDEPENDENT CLASS OF PEOPLE….the JEWS have been fighting mightily to maintain this independence, so have the Asians. Why not us? Why not Africa?

How about some of us march over here in Douglas County, Georgia for Genarlow Wilson who has been in jail for over year for having consensual sex with a minor while he was STILL a minor. In that case, no violence had taken place and race WAS NOT an issue but where was the massive support for him?? His story caught media attention, there were a few protests…. but I didn’t see 20,000 marching in Douglas County, Georgia. I don’t understand why people keep calling the white kid the “victim.” It’s not like he was an innocent bystander that just got his ass kicked for no reason. Thought it would be Oprah that did the show also.
The excuse I give myself is that maybe she didnt do it was bcuz she felt that her being black either side would think she was siding to one way or the other. Like talking to the white ppl when she posed a question they would feel like it was one-sided and when talking to black ppl (esp when alot of ppl have already labeled her as whitewash) they would instead be questioning her blackness. For instance if shes questioning the white ppl and asking if they felt the nooses was a racist act they might sugar coat or might not be truthful. And when questioning black folk about the white boy getting beat up by 6 black guys– black folk might say why shes asking about that when a whole lot of other funky sh*t occurred…and so on and so forth. When actually all she would be only doing is doing her job by asking these questions.

Dr Phil has said before that he has worked on many court cases, I agree with what was said earlier I would rather have him do it anyway bcuz of this. I hope he brings that all in your face attitude with him. And asks the hard core questions like he does on his show.

Praise God! The new about Michael Bell is wonderful but this isn’t done by a long shot.

I am also glad to see that Dr.Phil will be covering this story. I am a very big fan of his show because he gets down tot the nitty gritty of any situation and he’s going to expose the dirt!

What’s really funny about this whole situation is that all of this could have been easily prevented. I have concluded that some one of authority in that school actually wanted this to happen. NOW HEAR ME OUT BEFORE CRITIZING MY OPINION. Everyone is familiar about teachers and other staff arrives to school earlier than any student…right? With that fact in mind, I know someone of that facility saw those nooses on the tree yet they allowed them to hang. So I am starting to wonder whether if this was intentional on behalf of the staff. Everyone’s been speaking about the kids who hung the nooses; the actual fight of the six young men and the ruthless charges brought against them but no one is holding the staff accountable for this matter. Now think about it. Before the all even played out, (according to the media) one of the black students did ask the principal if he could anywhere in the school or sit underneath that tree (I can’t remember the exact wording) and the principal responded with, “You can sit anywhere you like.” That was the first red flag of something is about to go down. I don’t know…maybe its just be but something isn’t right.

We all need to give thanks to God first and foremost, the volunteers and civil rights activist, and most importantly, we all need to know about the Southern Poverty Law Center (SPLC), and donate to them! The Southern Poverty Law Center was started by Jullian Bond (MLK Alumni) and Morris Dee’s. Who I actually got to meet him 4 years ago in Idaho. Of all places huh?

I have personally witness the power of SPLC, when they came to Idaho, when I was attending Graduate school, and they bankrupted the Arian Nation Compound in Northern Idaho. They were sponsored and back by large technology companies in Silcon Valley, Ca…Morris Dee’s and the SPLC has been breaking down these racist groups and issues for years…WE NEED TO DONATE TO THEM! It was the SPLC attorney that went to the Defense in Jena, LA.

I use their anti-hate/tolerance lesson plans when I worked in Idaho with the Girls Scouts, and support them greatly! Thank you Morris Dee’s, Jullian Bond and the SPLC, for continuing to be on the forefront of upholding racial justice in this great land we call America!

Yah it’s good to hear that he is being tried in Juvenile court instead of as an adult. I believe that the they guys he beat up should be right along with him facing charges as well. I don’t think that it’s right that he fought them. Why not get them back by doing other things like going to a higher authority and make his voice heard? Now look at him, facing charges. HOUSTON — No sooner did tens of thousands of African-American demonstrators depart the racially tense town of Jena, La., last week after protesting perceived injustices than white supremacists flooded in behind them.

First a neo-Nazi Web site posted the names, addresses and phone numbers of some of the six black teenagers and their families at the center of the Jena 6 case and urged followers to find them and “drag them out of the house,” prompting an investigation by the FBI.

Then the leader of a white-supremacist group in Mississippi published interviews that he conducted with the mayor of Jena and the white teenager who was attacked and beaten, allegedly by the six black youths. In those interviews, the mayor, Murphy McMillin, praised efforts by pro-white groups to organize counterdemonstrations; the teenager, Justin Barker, urged white readers to “realize what is going on, speak up and speak their mind.”

The Jena 6 case has drawn scrutiny from civil-rights leaders and hundreds of African-American Internet bloggers concerned about allegations that blacks have been treated more harshly than whites in the criminal-justice system of the town of 3,000, which is 85 percent white.

David Duke, the former Ku Klux Klan leader, last week announced his support for Jena’s white residents, who voted overwhelmingly for him when he ran unsuccessfully for Louisiana governor in 1991.

“There is a major white-supremacist backlash building,” said Mark Potok, a hate-group expert at the Southern Poverty Law Center, a civil-rights group in Montgomery, Ala.

On Thursday a crowd of at least 20,000 peaceful demonstrators from around the country marched through the central Louisiana town to support the six black high-school students who were initially charged by the local prosecutor with attempted murder for attacking Barker last December. The charges were later reduced to aggravated second-degree battery.

The racial unrest began when three white students hung nooses from a tree at the high school after black students asked permission to sit under it, triggering a series of fights. The whites involved were charged with misdemeanors or not at all while the blacks drew various felony charges.

I have been jumped, and jumped other people, (with and without blood). The most I have seen ANYONE get for any fight was PROBATION or a misdemeanor ticket and that is as an adult. I hope the DA looses his job for child abuse! Because doing that to a 16 year old is EXACTLY what that is! This can really mess peoples head up because long court cases are mentally draining. OK, granted NOT ALL of the white people in Jena are a racist, but MOST of them are and the non racist ones KNOW that, so why are ma’fuckas so in denial. That trick biy-otch of a teachers aid on the Dr. Phil show needed her fact ass kicked too for the simple fact she tried to shift the blame on black leaders not praising one simple accomplishment they have contributed to their race, which by the way, have all been NON VIOLENT! If she was legitimate in her arguement, she would have acknowledged yes, there are a lot of racist people in Jena, but not all, the beating was wrong, the kids should have been suspended or put on probation as are 95% of all other school fights,(not including Jena 6, but all parties involved in the racist incidents), but no, the bitch wanted to just bash the black people not recognizing that this was a reaction to prior events!

Mr. Bell was justified. He went to the authorities asked them to defend his rights, He was ignored. Thus the authorities — the government — provided defacto support for the racist actions of the whites. @ 80 but some of the reasons why besides the fact that yeah some actually do crime is what I wonder about…..something fishy on us being almost 13% of the population and with that population like maybe 65-70% of our population is us (women) but about the same percent of the black men are in jail. I’ve seen people jumped and the school handled stuff like that…..not the police…..i’ve seen kids get 14-25 days and stuff like that for fighting and with worse injuries than the Barker boy…

I watched most of the Dr. Phil show……I could type a page on what I did see….the show continuing Monday I’m dying to see but I have class 3:30 to 5 then and I can’t record it…….I really hope Mychal doesn’t have to do anymore time……doing almost 4 yrs. in a detention center is just wrong….he did 10 months in an adult jail already gotdamn smh.

In these 10 months I feel how Walters and the judge went about this is pretty much criminal.

I work with young children in the elementary - middle school age range. At such a young age, many of them already possess an ‘I don’t care attitude’. Many of these children come from broken homes or unstable homes, their parents are in their mid-late 20’s. There is a generation behind us that is watching and absorbing everything that we do. We have to lead by example and by making informed decisions. By now, I think we have all realized that our generation does not have solied, reliable leadership as our parents and grandparents had in the 60’s. WE ARE OUR OWN LEADERS, and we must lead by example. There is another generation growing up behind us and looking up to US because many of them do not have someone at home to look up to!

Wow…its jumpin on in here…well let me add my ten cents:

1. Dr. Phil: Good for him. It is about time that a mainstream white media person begin to speak about the issues of racism and racial injustice because THAT’S WHERE THE CONVERSATION NEEDS TO START. Racism is about the institutionalized acceptance that certain groups are preferred and selected for access to opportunity and services so it is so important that people in power have this discussion because people not power (Black People) have had this discussion for centuries.

2. One of the big problems in our society is that the juvenile justice system has changed from rehabilitative to punative over the last 30 years (an perhaps even more so in Black Urban centers). Having said this, it is no wonder that Bell and many others are facing harsher punishment and it is good that we are having these discussions about the proportionality of punishment to the charge act. This sort of stuff of the Jena Six rings so true to the Furman v. Georgia or the Scottsboro boys or African American men being charged with ambiguous acts of moral turpitude so that they could be denied the right to vote. So it is so important that we challenge disproprtional punishments.

3. Having said all that: my understanding is that the last of the young gentlemen has a criminal record and was currently on juvenile probation at the time of the event. (Please correct me if this is not true) If it is true then this is where it gets touchy and where the judge may be in his right to punish him differently than the others. Also, if I am not mistaken, juvenile courts do not have juries (there is a certain logic that prevents juvies from having the same sort of due process as adults).

That’s partially correct — but bottom line, Blacks Voting RIGHTS will not be revoked, the 15th amendment guaranteed the rights of all citzens to vote, but many southern states enacted Jim Crows voting requirements that effectively prevented and intimidated Blacks from voting.

In 1965 the Voting Rights Act was passed, but it didn’t guarantee Blacks the right to vote, Blacks already had the right, it just provided for the ENFORCEMENT of that right. It authorized the federal government to send federal registrars to register voters and federal agents to protect voters and insure that they were allowed to vote.

The voting rights act was intended to be temporary - initially set for 5 years, then 7 years and then another 25 years ending in 2007. Even if it is not extended, it will not take away our right to vote.
