Earlier this week we blogged on that heinous HATE crime that went down in West Virgina last week. Well here is new info on the case.
On Wednesday (Sept. 12th) it was reported that the six white suspects accused of torturing Megan Williams for almost a week will not face federal hate crime charges. Logan County Prosecutor Brian Abraham said his office would pursue other charges first because they carry stiffer penalties. West Virginia’s hate crime law carries a sentence of up to 10 years.
It was also reported that Megan Williams dated one of her attackers, Bobby Brewster. This interns undermines the hate crime law, which applies to crimes motivated by racial hatred and not by non-race-related conflicts.
It was widely reported that Williams was assaulted with a knife, while being taunted with racial slurs. So just because she dated and knew the attackers this isn’t a hate crime? Some people are saying that this is a good/bad thing. As I stated, a hate crime charge carries a lesser sentence.
Community leaders and preachers spoke on behalf of the Williams family on Thursday about the prosecutors decision in the case.
“If it looks like a duck, quacks like a duck, acts like a duck and walks like a duck, it has to be a duck,” said Rev. Emanuel Heyliger, who represented the family during the press conference. He said if Logan County officials don’t file hate crimes charges, federal government officials should intervene. [SOURCE]
Various media sources are reporting that Megan Williams suffered from some sort of mental disability, but I couldn’t find any confirmed reports.

This is crazy! When a black person is tortured by a group of white people, a hate crime is the first thing that comes to mind. Whether this young woman dated one of the attackers or not doesn’t take away from the fact that what was done to her was horrible. And to endure that kind of torture for a week! The justice system in this country really needs to be renegotiated.

They explained in one of the articles online that the reason the prosecution wasn’t sure about charging this as a hate crime is because the hate crime maximum sentence is only 10 yrs, while the other charges they have been charged with all carry hefty maximum sentences (all of which are no less than 25 yrs). I understand the rational behind that, in a sense, they want these people to get the maximum amount of time possible…however it is still a clear cut case of a crime commited with hatred in mind.

sidenote: This also wasn’t the 1st incident that she had with some of these people. In July of this year, the main guy and her had apparently had some sort of relationship and the police had been called to the residence before about a domestic disturbance between Megan and him and he was charged with domestic battery.

Those are serious charges, the old bag’ is going away for the rest of her life, im not sure on the sexual charges, but malicious wounding is here in VA, 5-15yrs, and thats just one charge.

This is really all about evidence. They can charge them with whatever charge they choose if they don’t have enough evidence to convict it really does not make a difference what the charge is. I understand the logic of going for the charge that carries the stiffest penalty but what if they don’t have the evidence to convict on these charges. And I am just putting it out there because of the world we live in, but what if they are purposely going after charges they know the defendants can beat. At #15- have you heard of the “snippers”- Malvo and Boyd. The two crazies (both black) who went around shooting people in the DC area?? Well the Feds AND the State of VA BOTH bought charges against them and took them to trial. BOTH the Feds and VA State have the death penalty. What purpose did it serve to have them bought up on BOTH Federal and State death penalty charges when a person can only be killed once? Simple- if ONE case did not yield sufficient evidence and only resulted in a life sentence then the death penalty can still be imposed in the other jurisdiction. The excuse that WVA has ‘stiffer’ hate crime penalties is a load of crap because the Feds can bring charges and any resulting sentence can be served CONSECUTIVELY- meaning they can sit and waste away for the 6 years in a Federal Pen (which is always harder time then the state) AND THEN serve time in a WVA jail – or vice versa… The fact that the Feds came in like gang bustas and took over a dog fighting case in VA (Vick) but yet they choose to not bother to bring Federal charges against these monsters just reiterates that “our” blood is cheap and not valued nearly as much as tjhat of a pitt bull. I take comfort in knowing there is a special place in hell reserved for these six AND for those who choose to turn a blind eye and not impose the penalties that are so blatantly merited in this situation.

Sad but True, the Law looks at matters differently when the victim knows their attacker.
Had they been complete strangers, the attackers would get more time and stiffer charges.
This is why ‘domestic disputes’ are not treáted with the same severity as crimes between strangers. The courts assüme that thère is a history between the two that could have caused or even pervented the attack. Between strangers, that would not be the case.
This case is deploprable to say the least! My concern is not if this is a hate crime or not (all crime is an act of hate on some level as far as i’m concerned), my concern is that they get the maximum time in prison!
Umm, #47 being charged with a Federal hate crime is NOT mutually exclusive of being charged and tried in the State. It happens all the time every day.. AND quite frankly if the county misdemeanor carried 100 years I would be happy to see them convicted on that misdemeanor and serve the 100 years. They can then be carted over to the Federal Court and be convicted of a FELONY and serve the 6 years.. 106 years is a nice fair sentence… No different than the two death penalty sentences Malvo and Boyd are serving… I am a firm believer that a criminal is a criminal AND they should ALL be treated the same.. You want to charge Vick on Federal charges fine (the state declined to press charges)… You want to charge Malvo and Boyd and lock one up on two consecutive life sentences, the other on consecutive death penalty sentences- fine.. So when a white person commits equally heinous acts I believe they should rot in the same Federal AND State jails… What’s good for the goose is GREAT for the gander…
When these folks go to prision, the inmates are going to have Hella fun with them. Give them the stiffer sentence and throw away the key.
Honestly I know how some black people have pride of where they live and stuff, but to be honest I wouldn’t ever live in places like West Virginia because the black percentage is so low you are bound to run into trouble…Not to say that every blk person should move into inner cities or the hood, but I think we should learn more about the market and investigate places we choose to live sometimes and do some research on past crimes and things in that area. at #15, so you dont think that they will bring in federal charges? What they did are felonies, and depending on how the state is….is what plays the biggest role. I will tell you right now, if you want to do something bad DO NOT do it in Va. I repeat, DO NOT do it in Va AKA the commonwealth. Our laws are worst, and i am not tlaking about W. VA. Different places, similar names for those that dont know how laws are very different between the two.
The reason why vicks case was handled the way it was, was because A. he was a celebrity, and B. it was in the commonwealth. The laws are wack in VA around here and thats why it was handled the way it was.
