They explained in one of the articles online that the reason the prosecution wasn’t sure about charging this as a hate crime is because the hate crime maximum sentence is only 10 yrs, while the other charges they have been charged with all carry hefty maximum sentences (all of which are no less than 25 yrs). I understand the rational behind that, in a sense, they want these people to get the maximum amount of time possible…however it is still a clear cut case of a crime commited with hatred in mind.

What purpose did it serve to have them bought up on BOTH Federal and State death penalty charges when a person can only be killed once? Simple- if ONE case did not yield sufficient evidence and only resulted in a life sentence then the death penalty can still be imposed in the other jurisdiction. The excuse that WVA has ’stiffer’ hate crime penalties is a load of crap because the Feds can bring charges and any resulting sentence can be served CONSECUTIVELY- meaning they can sit and waste away for the 6 years in a Federal Pen (which is always harder time then the state) AND THEN serve time in a WVA jail - or vice versa… The fact that the Feds came in like gang bustas and took over a dog fighting case in VA (Vick) but yet they choose to not bother to bring Federal charges against these monsters just reiterates that “our” blood is cheap and not valued nearly as much as tjhat of a pitt bull. I take comfort in knowing there is a special place in hell reserved for these six AND for those who choose to turn a blind eye and not impose the penalties that are so blatantly merited in this situation.

Sad but True, the Law looks at matters differently when the victim knows their attacker.

Had they been complete strangers, the attackers would get more time and stiffer charges.

This is why ‘domestic disputes’ are not treáted with the same severity as crimes between strangers. The courts assüme that thère is a history between the two that could have caused or even pervented the attack. Between strangers, that would not be the case.

Umm, #47 being charged with a Federal hate crime is NOT mutually exclusive of being charged and tried in the State. It happens all the time every day.. AND quite frankly if the county misdemeanor carried 100 years I would be happy to see them convicted on that misdemeanor and serve the 100 years. They can then be carted over to the Federal Court and be convicted of a FELONY and serve the 6 years.. 106 years is a nice fair sentence… No different than the two death penalty sentences Malvo and Boyd are serving… I am a firm believer that a criminal is a criminal AND they should ALL be treated the same.. You want to charge Vick on Federal charges fine (the state declined to press charges)… You want to charge Malvo and Boyd and lock one up on two consecutive life sentences, the other on consecutive death penalty sentences- fine.. So when a white person commits equally heinous acts I believe they should rot in the same Federal AND State jails… What’s good for the goose is GREAT for the gander…

@71 a mandatory sentence on a crime charged does not guarantee a conviction. So for example, if for some reason the State botches the case or the cops ‘lose’ evidence OR a technicality results in a LESSER charge ultimately going to the jury/judge then that in turn will result in a LESSER sentence.. The purpose of indicting someone on BOTH Federal and State charges is to have two bites at the same apple while avoiding a ‘double jeopardy’ argument.. That being said, I still say folks need to understand how this crazy system works (especially when it comes to “us”) and not be complacent with the BS reasoning given for the Feds decision to not pursue FEDERAL charges. It’s not about calling it a ‘hate crime’ or ‘making a point’ — it comes down to ENSURING that if/when ONE botches it there is still a shot at locking them up… Remember the OJ Simpson case (as if anyone could forget! hahahahaha).. They wanted to indict him in a Federal court after the State not guilty verdict but they could not find any charge to bring against him…

The story plainly says that if the prosecution goes with a hate crime that the maximum sentence is 10 years vs. the 25+ years if they just stuck with the basic charges.

Sure, let’s all just call up Al Sharpton, have him throw pressure on the DA to go for the hate charges, and watch those mother fathers get out in 10 years, 6 with good behavior. So where the hell is the justice in that?

The whole story is sad and tragic and my heart goes out to her and her family. The fact of the matter when this kind of crime is committed regardless against what race, by what race its a hate crime, period. The question is would we rather have it labeled as a hate crime and see these sick, sorry individuals not even get a quarter of the time they truly deserve. Or do we want them to charge them with the heaviest charge that the law would allow so that these sick SOB’S don’t see freedom for a long time. Truth be told a situation such as this there is not enough time any Judge can give them that will be satisfactory. This is appalling, I was just reading on GlobalGrind.com that the case will not be tried as a hate crime, which I think it should be. Just because one person out of 6 knew the girl? Turn the tables and have the victim be a white female and watch how fast the case would be tried and those criminals be given a life sentence. This makes me sick.

Hate crime= less time in jail

Not a Hate crime= more time in jail, more severe punishment.

I would rather have them in jail for a really long time so that they don’t have the opportunity to do something like this again. We all know it’s a hate crime and so do the prosecutors, but they obviously want to give these people the harshest sentence they can. And the only way to do that is to forgo the hate crime thing.

I would go for the harsher punishment even if you have to overlook it being a hate crime.

It has also been reported that not only did she date Brewster, but there is a domestic violence charge against him from July 2007. It’s also been reported on a newscast, but I can’t find it in print anywhere that the mother and son have both killed before. The son killed his stepfather when he was 12 and the mother killed a woman in the same trailer a few years ago.

I read somewhere else that they were dropping the hate crimes and were going to go ahead and prosecute them on more serious federal criminal charges which all carry more time. If that is true then good but what they did to her are still hate crimes but the more time these sons-a-bitches gets then the better. And they need to definitely review and revise wth a hate crime is.

These things will get what they have coming to them. Trust…i could care less how her attack is worded in the courts…her injuries is evidence, the law knows that she was held against her will, she was raped, tortured, burned and forced to do god only knows what. Last but not least, her attackers all have records with assault and what not so I want to have faith that the law will work in the victim’s favor. If she was a minor, it would be a wrap. I feel that it was a hate crime but If we all find out that these people have to spend more than 10 years in jail, we will all be happy.

In comparing this to the Jena6 we have to remember different state, different judges, different DA’s, different everything. So yes a typically school fight is bringing more charges than a woman nearly killed, but we are more than 500 miles apart.
