The marriage was doomed once she signed the prenump. In the event of a divorce, she was banking on the child support from the jump and was obviously cool with the set up. JENA, La. (AP) — A judge has thrown out one of the two charges against the first black student tried for beating up a white student at Jena High School, saying juveniles cannot be charged with conspiracy in adult court.

But Judge J.P. Mauffray Jr. rejected arguments that, for the same reason, he should throw out the aggravated second-degree battery charge on which Mychal Bell also was convicted.

The judge’s decision means Bell will face at most 15 years in prison rather than 22 1/2 when he is sentenced Sept. 20.

Bell, the first of the students known as the “Jena Six” to go on trial, was 16 when he was charged with attempted murder of the white student, Justin Barker.

Murder and attempted murder are charges on which a juvenile can be tried as an adult, but aggravated battery is not, defense attorney Bob Noel argued.

He said LaSalle Parish District Attorney Reed Walters used “bait-and-switch” tactics to try Bell as an adult. Bell was indicted on a charge of attempted murder, but Walters changed to the battery charge before trial, as he did Tuesday with the charges against two more students, Carwin Jones and Theo Shaw.

But Mauffray agreed with Walters that, once a case against a juvenile is in adult court, reducing the charge did not automatically return the case to juvenile court.

Walters quoted state law: “The court exercising criminal jurisdiction shall retain jurisdiction over the child’s case, even though he pleads guilty to or is convicted of a lesser included offense.”

Bell’s attorneys said they would appeal that and another rejected request to return the case to juvenile court. Walters said he would appeal the conspiracy ruling.

Bell’s attorneys also argued that the convictions should be thrown out because there was no evidence of conspiracy or of the dangerous weapon required for an aggravated battery charge. Walters has said that weapon was shoes. Louis Scott, another of Bell’s attorneys, said there was no evidence that Barker’s injuries were caused by tennis shoes rather than a punch or hitting a wall.

People in the packed courtroom sometimes cheered or made loud noises of disgust or disbelief during the arguments.

He gained his most prized possessions from her and I’m sure he would agree with that. Those children (all of them) are his legacy. As the mother of his children, she is entitled to respect. In response to Dats post #238, I NEVER, EVER said that Shaunie stayed with Shaq because of love. You assumed that’s what I thought. SOME people who get married actually intend to honor the vows they said before God, and neither YOU or I know if that’s why she stayed. Or how about this one, maybe she stayed FOR THE KIDS? I don’t know much about their relationship or what is going on, so I will try not to speculate, but just say this. People look at Shaunie and say , wow, this woman had it all, a rich husband , whose famous and gave her anything she wanted. She looked so happy, what went wrong, and she didn’t appreciate him. Well, many women are or were married to men and the world see their lives as grand. But, it’s not real. When women are married to men that are the sole providers, they are inevitably trapped in a situation that is to hard to explain. Although, men give their wives material things, noone knows what that woman has to go through , to get those things. Noone knows what Shaunie was going through in the relationship, so why speculate. And say she was wrong, we don’t even know the facts, just Shaq’s side of the story, actually his reasons for filing a divorce. Shaunie probably only wanted to buy things, or wanted a new house and that infuriated Shaq, and he pulled something drastic, only to show Shaunie who was the dominant or controller of their relationship. He obviously, couldn’t handled the fact that she was making financial decisions on her own, and had business savvy, he forgot that women are more than bed warmers and mothers. If anything he should applaud her Queen attitude, and be happy that she was smart enough to take care of business, because if she can look after herself, she is more than capable of running his estate, probably better than him.
