Georgia’s Supreme Court on Friday ordered the release of a young man who has been imprisoned for more than two years for having consensual oral sex with another teenager.
The court ruled 4-3 that Genarlow Wilson’s 10-year sentence was cruel and unusual punishment.
Wilson, 21, was convicted of aggravated child molestation following a 2003 New Year’s Eve party at a Douglas County hotel room where he was videotaped having oral sex with a 15-year-old girl. He was 17 at the time.

First let be say that I disagree with the ruling. He served two years for his CRIME and yes it was a crime. This was what he was offered but rejected it to go to court. So he deserved all the 10 years he was sentenced to. What was a 15 year old doing at a hotel room at night? Why did this young man have so little respect for hinself that he would sleep with one girl while she was clearly pass out and another girl who thinks so little of herself that she would degrade herself in that way. Now again I asked, Where are the parents? There was nothing wrong with the law. Teenagers should not be doing those thing. This is what happens whe you let music and TV rasie your kids. Whats confusing is there are alot of post that seem to make light of the fact that 15 year old had oral sex with four 17 year olds. Thats not ok. And if you reserch the facts you will see that these so call bright young men are known for degrading girls all round the school. It that the kind of role model you want for your boys, or dating your girls? And remember AIDS is a real thing and it has no age.
And I hope that was all understand that what he did is wrong still under the law. The only change is the time sentenced, he does not have to reguester as a sex offender, he is not a felon anymore. IT IS STILL ILLEGAL TO RECEIVE ORAL SEX FROM A MINOR NO MATTER THE AGE, BUT IT IS NO LONGER A FELONY.
People forget to include the rest of the story where he and his friends had sex w/ a 17yr who was unconcious and video taped it. You don’t run a train on an unconcious person – period. The 17yr girl was alledgedly intimidated out of testifying against him for the rape charge as so many woman are, so if you ask me, he got off easy. I hope he and these young girls make better decisions in the future and I hope other young people learn from this example and think more carefully about trying to grow up so fast and emulate the wild sexual fantasies they see played out on t.v.

This 15 year old BLACK GIRL offered and performed oral you know what and that’s how he got in trouble… She wasn’t 16 so she wasn’t legally able to consent… It’s pretty lame, but on a happier note…
He’s a good looking fellow and with all this support, he’s sure to be alright even after a couple years in jail…. His life just isn’t gonna go the way he thought it would at 17….

Now I know that some of you are going to say that were talking about this case and the case about the other girl…well I agree too that the law is messed up and the sentence was harsh for this type of case….but in the end I think the 2 yrs Wilson served was Karma for what he and the five other guys did to the other girl (the one that everyone else forgot out) that night…..FYI the other girl said she never consented to having sex with six boys while passed out and being videotaped during the process.
I hope Wilson learned his lesson through all this and I wish him the best in the future.

In response to a petition of habeas corpus filed by Wilson’s attorneys, the Superior Court of Monroe County in the State of Georgia reduced Wilson’s charge to misdemeanor aggravated child molestation, ordered that his name not be placed on the sex-offender registry, and resentenced him to 12 months and with credit for time served. Stated Judge Thomas Wilson, “The fact that Genarlow Wilson has spent two years in prison for what is now classified as a misdemeanor, and without assistance from this Court, will spend eight more years in prison, is a grave miscarriage of justice.”[15]
Georgia’s Attorney General Thurbert Baker, an African American, has appealed Judge Wilson’s decision, staying Genarlow Wilson’s release. Baker maintains the judge did not have the authority to overturn the conviction and says there is a plea bargain offer on the table.[16]
According to Baker, the plea deal could allow Genarlow Wilson to be eligible for First Offender Treatment, which would mean that he would not have a criminal record nor would he be subject to registering on the sex offender registry once his sentence had been completed. It could also result in Genarlow Wilson receiving a reduced sentence, possibly leading to his release based upon time already served. Genarlow Wilson’s lawyer, B.J. Bernstein, would not accept the proposed deal because it would require her client to plead guilty to a felony with a fifteen year sentence; thus Genarlow would be forced to register as a sexual offender for up to fifteen years.
This is the same deal offer before he went to trial.

Ummm….I dont know where some of you got your info from but the girl was white. She could have said she consented all day long but in Ga the legal age of consent is 16 so technically she really didnt have consent to give. The really messed up part is if he had just had intercourse with her it would have been a misdemeanor and not a felony.

They did not gang rape that other girl. She was visibly drunk but she was not unconscious and did not say no or stop. They tried to charge them but the tape did not prove what they were told by the second girl to be true. If the tape showed what you stated they would not have needed her to testify so I doubt the intimidation rumor.
That case was damn near retarded and it only punished the male when the female initiated the act. She may have been a victim but she was not his victim. She was a victim way before she walked into that hotel room. She was a victim of neglect, low self esteem,self hatred, and non existent parenting.

And further, this doesn’t vacate his conviction but reduces it and simply put says he served his time for the criminal act he was convicted of. I wonder how much of a life he will actually have.

# 124 the 17 year old girl was intoxicated, not unconscious. Big difference. There was a videotape, had she actually had been unconscious he would have been convicted of rape.
Unfortunately, this kid can’t sue for anything because his conviction was based on an actual law. He wasn’t (technically) wrongfully imprisoned.
The funny thing about this case is when he was in court for sentencing, a 26-year old teacher received a 3 month sentence for having sex with her 16 year old student. She was being sentenced in a court room right down the hall from his.

The fact of the matter is that is was not a boy and a girl doing a lude sex act. It was a 15 year old girl and six 17 boys. Thats a Freshmen and 6 seinors. Even if you dont think this is wrong, you have to appericate the fact that at the age of 15 you cant consent. This is in every state in America. Genarlow said he didn’t do it, then he said yea I did it but it wasn’t illegal, when they told him his options he chose to go to trial. The DA did not think 10 years it was fair so he offered all 5 of the boys pleas. Two years, one in jail and the other on papers. This is what Genarlow is now concvited of. He was not aquited. They let him out of jail for time serve. He could have faught this battle while he was at somebody’s college, instead of in jail still talking about he aint do nothing wrong. Most of the boys didn’t even serve all of the year. This aint OJ, they got him on tape having sex with a drunk girl. Which he claims is ok cause she did say no, weather she could or not.

God is good. I read the article on him awhile ago because my auntie at work emailed it to me and I was actually pissed over the story. I understand there are different laws in different states but that 10 year sentence was ridiculous. I honestly signed the petition and hopefully that was something that help. God bless him and his family and I hope he can move forward in a positive direction.

He is a wonderful person and that is all I have to say about him. To clear up what some people are saying… Yes there were two girls but both girls were BLACK. His sister is 9 years old and was much younger when this happend so in no way this girl close to his sisters age. The girl was a hoe and she knew what she was doing. He did not force her to do anything and if you knew her you know that she would do anybody.
